Good question.
Clearly, freedom needs to be limited. I find that the people who advocate the minimum government interference under the pretense of "maximizing freedoms" are generally assholes who don't want moral considerations to get in the way of them doing whatever the fuck they want.
I'd like it if humans were enlightened to the point that formal laws were unnecessary, but it's simply not a reasonable or realistic thing to advocate given the current state of affairs in the world.
Anyway, as for your particular example, no, maybe we shouldn't allow a perfectly good house to be torn down to build a new one.
We absolutely should not allow a perfectly good forest to be torn down in order to build houses. I'm sure there are laws to that effect in place already, so it would be interesting to apply that idea to an urban setting.
